Terms and Conditions

COMPANY’S OBLIGATIONS

While the vehicle is within our premises, it will be insured by the insurance company of OK Parking Ltd.

OK Parking Ltd. is responsible for loss, theft, or damage to the exterior of the vehicle only if it can be proven that the damages were caused by negligence on the part of OK Parking Ltd. and are demonstrated before the vehicle’s removal.

OK Parking Ltd. assumes no responsibility for any damage or theft of accessories and items that are not fixed to the vehicle. This includes, among others:

– Theft of the Radio/CD receiver/removable front panel.
– Theft of personal belongings: mobile phones, tablets, laptops, clothing items, bags, or any other items customers have left in the vehicle.
– Theft of vehicle documents (we remind you that as the vehicle owner, you must not leave any original vehicle documents when you leave your vehicle in our facilities; instead, you should provide us with photocopies of the most relevant documents).

OK Parking Ltd. is not responsible for mechanical and/or electrical breakdowns that may occur during the vehicle’s stay in the parking lot. Likewise, OK Parking Ltd. will not cover wear and tear due to usage on all exterior and interior parts and components of the parked vehicle.

OK Parking Ltd. will not be held responsible for imperceptible damages, both interior and exterior, if there is insufficient light, adverse weather conditions, or excessive dirt to conduct a proper inspection of your vehicle. Visual inspection is not reliable under such conditions, and these damages may be unnoticeable in photographic documentation at the time of receiving your vehicle. This prevents potential confusion when claiming very minor damages that become visible when the car is returned cleaned and without the dirt that concealed them at the start of your journey.

OK Parking Ltd. is not obligated to clean the parked vehicle; the contracted service includes storage and transfers. The offered cleaning is a courtesy provided by the parking as a gesture of goodwill towards its customers. Therefore, customers waive the right to make any claims regarding cleaning.

USER’S OBLIGATIONS

– It is the customer’s responsibility to remove all non-fixed items and accessories from the vehicle, such as radio panels, mobile phones, vehicle documents, bags, etc.
– The customer must ensure that the vehicle will be delivered at the agreed-upon time between the customer and OK Parking Ltd. Failure to deliver the vehicle at the appointed time may result in additional costs.
– The customer must provide 24 hours’ notice for an extension of their original reservation.
– The customer must provide OK Parking Ltd. with the vehicle’s key.
– The customer must ensure that the vehicle is legally documented and in a condition to be driven, including taxes, valid ITV certificate, insurance policy, etc. In many cases, OK Parking Ltd. receives and delivers the vehicle at the designated meeting point (e.g., Alicante Airport). Therefore, OK Parking Ltd. reserves the right to deny entry to any vehicle that does not meet the requirements stipulated by Spanish law.
– If a repair is required on the vehicle, the customer must carry out the repair at the parking’s designated workshop with express authorization from the insurance company’s assessor.
– While the customer drives their vehicle on the company’s premises, the customer is responsible for any damage that may occur and any associated costs.

CANCELLATIONS, FEES, AND REFUNDS

– Confirmation of a web booking request does not guarantee a specific space for your vehicle in the parking area.
– For all parking reservations, OK Parking Ltd. must be informed of a cancellation in writing or by calling (+34) 952 002 089 – 966 441 529.
– OK Parking Ltd. has the right to restrict or cancel reservations. All services are subject to availability.
– Prices may vary by periods, and while OK Parking Ltd. will make every effort to maintain prices, we reserve the right to change prices without prior notice.
– Customers with annual contracts have 15 days from the start date to request a cancellation and will receive a refund minus the number of days used, applying the normal daily parking rate plus a €50 cancellation fee.
– Payment for the service will be made upon your return and in cash.
– In case of a same-day reservation, the customer will need to pay €4.97 (€5), which is the penalty we incur due to not being allowed to approach customers at the terminal itself, and we must inform our customers before midnight to be listed as legitimate customers.

RESPONSIBILITIES

– OK Parking Ltd. has the right to retain the vehicle as collateral for any kind of debt with the company.
– Claims about vehicles cannot be considered unless they have been reported before leaving the premises.
– No responsibility is accepted for the loss or damage of vehicle components and accessories unless it can be proven that it was caused by negligence on the part of OK Parking Ltd. Damages must be marked on each part and list all existing damages on the same part. The customer must indicate the presence of more than one damage on the same marked part by the attendant. If no additional notes are present, OK Parking Ltd. will not entertain any claims in this regard.
– OK Parking Ltd. will not be responsible for the loss of the document that certifies and allows for the removal of the vehicle. If the customer loses their receipt and the vehicle is removed by another person for fraudulent purposes, OK Parking Ltd. will not be held responsible.

DATA PROTECTION

In accordance with the provisions of Organic Law 15/1999, of December 13, on the Protection of Personal Data, we inform you about the inclusion of your personal data in a file owned by OK Parking Ltd., for the purpose of facilitating our services. We also inform you that OK Parking Ltd. has adopted technical and organizational measures that guarantee the security of personal data and prevent their alteration, loss, processing, or unauthorized access, taking into account the state of technology, the nature of the stored data, and the risks to which they are exposed, all in accordance with the provisions of Royal Decree 1720/2007, of December 21, which approves the regulations for the development of the Organic Law on Data Protection.

If you do not wish to receive commercial communications from our company or wish to exercise your right to access, rectify, cancel, and oppose your data at any time, you can do so by notifying OK Parking Ltd., through a letter addressed to C/. Nicolás Gogol, 14 – 29004 Malaga.
